Corruption in the judiciary is pervasive. Many judges issue rulings that do not appear to have any basis in law or fact, leading some to believe that the only plausible explanation is corruption or political pressure. Broad immunity enjoyed by judges prohibits prosecutors from investigating corruption allegations until they make a public request to the High Council of Justice to lift the accused judge’s immunity, and receive its approval. Few judges have been prosecuted for corruption because most criminal investigations must remain secret, at least initially, in order to be successful.

[17 October, 2011, Strasbourg] Following the dissemination of the Technical Paper (CMU-PACA-07/2011) on “Immunities in Council of Europe Member States: Legislative, Executive and Judicial Office Holders” in late March 2011, and PACA roundtable event on “The System of Immunities in Albania: Comparative Analysis and Assessment of the Stakeholders’ Positions” held on 12 April 2011, PACA has prepared a second Technical Paper (CMU-PACA-19/2011) on ‘Recommendations for the Future Regulation of Immunities of Elected Officials in Albania’. This second paper is intended to be the key input to a final Conference to be held jointly by PACA and EURALIUS projects on “Reforming the Albanian Law on Immunities: The Path Ahead” which will take place on 18 October 2011. The aim of the conference is to review and discuss the recommendations and to achieve the agreement on the reform path to be chosen.

f The Police Assistance Mission of the European Community to Albania has drawn a detailed report sinking the Ministry of the Interiors and the State Police while belying all the propaganda of the power on the alleged success of the police in the fight against crime and trafficking.
SOT newspaper is in possession of a copy of the full PAMECA report of more than 100 pages which analyses the failures and successes of the police. Differently from the utopian depiction of the old propaganda of the Ministry of the Interiors, the mission states eleven reasons why the Albanian police has failed.
1. The lack of a data processing directorate to lead and control and take responsibility for the collection and control of intelligence;
2. Lack of computers for all state police officers connected with Memex system;
3. Lack of standard operational procedures to control police information;
4. Lack of a logistic server based on geographic division;
5. Insufficient knowledge on scientific evidence.
6. Lack of consuming articles for the Directorate of the Scientific Police;
7. Insufficient capacities for DNA tests;
8. Unfair division of tasks among specialists (some bear the brunt);
9. The failure of the police can be also attributed to the lack of willingness from the chiefs to ensure a consistent and increasing intelligence supply from the police officers as well as the inquiring structure experts.
10. Lack of civil recruits knowledgeable in certain fields of science and technology;
11. -The State Police can be intruded by the power in decision making processes.

Thank you for inviting me to speak again at your National Judicial Conference. When I addressed this gathering last year, I emphasized the importance of an independent judiciary to a strong democracy. Now, a year later, I believe that the judiciary in Albania has grown even stronger. I commend all of you for the progress you have made.
This year’s Conference comes at an opportune moment to discuss developments in the strengthening of rule of law in Albania. Looking back on the last two years, or even on the year since you last convened, we can see that there has been a true strengthening of the State in Albania. The fundamental public sector institutions have been reinforced to create the foundations of the rule of law. Government, especially through the police and public prosecutors, is more aggressively attacking the criminal elements of society and enforcing law and order. The Parliament is stronger and more engaged in the governing process. And of course, the Judiciary has matured, asserted its independence, and is more effectively playing its proper role in the legal system. Together these institutions have shown an increased ability to withstand the challenges of those who would undermine public order through violence and intimidation to try to gain political advantage.
The United States has always been interested in helping Albania build democracy, achieve lasting stability and enjoy prosperity. I spend much of my time and effort trying to correct the persistent image in the Western media that Albania is still unstable. What may have been true in 1997 and 1998 is not true today. Albania has demonstrated, especially in the past month, that it will not descend into chaos with the first political confrontation.
Demonstrations are part of a democratic society, just as public debates are the essence of political campaigns and the electoral process. But these activities must remain peaceful. When they step outside the bounds of what is acceptable in a democratic society, Government has the responsibility to step in to ensure public order. Only in this way can it give its citizens confidence that its democracy is strong and that the state will protect their most basic rights.
As judges, you are crucial to making certain this democracy prospers. Without your active engagement and commitment, Government’s efforts to ensure public order and the rule of law would fail. The judicial process is the backbone of law enforcement. To be effective, the Judiciary must not only be independent, which you have essentially achieved. Judges must also be competent enough to command public respect. With the help of international donors working with the Law Faculty and the Magistrates School, you are increasing your ability to understand the technical aspects of the law and adjudicate more consistently.
