Judicial theater in Albania

Almost one year after the Court of Appeal issued a house arrest order at the address “At the Kamza Road”, the Supreme Court left in act the same verdict with 40 days of house arrest for the 45-year-old Turkish citizen, Abduselam Turgut, 11months after he fled Albanian.

The Supreme Court considered as valid the Court of Appeal decision, from which Abduselam Turgut made the escape from Albania, while the Prosecution insisted that he should be left in prison, since he was wanted from the German authorities for trafficking around 1 ton of heroine.

Since March 2011, when the Court of Appeal decided to break the First Degree Court decision, which gave to Abduselam Turgut the house arrest measure for 40 days, it took 11 months to the Supreme Court to reach a decision.

The cause was the absence of the defending lawyer. However, the suspect for heroin traffic needs no more favors, since he has been enjoying freedom since then.

He was left in house arrest by the Supreme Court in an apartment without an address, simply writing down “an apartment at the Kamza Road”. His raised a lot of concern in the justice institutions, but not at the High Council of Justice, which did not release a final report, although they declared that they were inspecting the judges that gave house arrest to a residence without address.

This comedy went on for one year, while another process was reviewing in parallel the Prosecution for his escape.

Another unique aspect in this case is that the Turkish drug dealer was sentenced with 1.5 years of prison by the First Degree Court, while the Supreme Court, four months after this decision, decided to issue a 40 days house arrest, although he fled the country thanks to the same measure.
